Terms & Conditions

DEFINITIONS

 

IoScoot - IoScoot is an electric motorbike sharing service operated by MPT Commercial Limited. Customers may rent a motorbike using the Meep Smartphone App which is also operated by MPT Commercial Limited.

 

Meep – Meep is a smartphone application (App) which is used to access the IoScoot service. The Meep App is available for download from the Google PlayStore and Apple AppStore. The motorbike may be rented from a designated area as indicated in the map and, following the rental period, must be left within the same designated area. For the sake of clarity, the motorbike may be driven outside the designated area too.

 

Renting – The use of the motorbike for a period of time against a charge. A rental may be commenced and terminated via the Meep App. The Renting of the motorbike constitutes the service being provided at a charge.

 

User – The person who will be Renting the IoScoot Motorbike.

 

Designated Area – The territorial area within which a motorbike rental may be started and terminated.

 

Vehicle – The electrical motorbike which is being made available to rent via the Meep App.

 

All interaction with the service will take place via the Meep Smartphone App. Customers must always abide by The Maltese Highway Code and must follow all the Maltese traffic rules and regulations. To drive the motorbike customers must be in possession of a motorbike driving licence which is valid for use within the Maltese territory.

1. TERMS AND CONDITIONS OF SERVICE

 

To access the service and use the available vehicles offered for a rental, the User must be registered with IoScoot.

 

All Users must meet the following requirements:

 

  • Be at least 18 years old.

  • Hold a current motorbike driving licence User which is valid for use within the Maltese territory.

  • Any motorbike licence (including AM, A1, A2 or A) or a Maltese B driving licence together with code 111 allows a User to drive the motorbike. Note that in the case of a B driving license with code 111, it is not possible to carry a pillion rider.

  • Hold a valid bank card.

The User must read and accept these general rental Terms and Conditions to proceed to use the service offered.

 

The User guarantees to IoScoot and undertakes to be solely responsible to any third parties for the validity and authenticity of his/her driving licence. The User guarantees that his/her licence is valid. The User shall be conversant with The Maltese Highway Code and must follow all the Maltese traffic rules and regulations.

The User may reserve a vehicle by accessing the Meep Smartphone Application. Each reservation will grant the right to use one available vehicle for a specific trip or period of time. IoScoot does not guarantee the availability of the vehicles when the User makes the reservation.


The User of the service must have a smartphone with an iOS or Android operating system with internet access. They must furthermore have installed the Meep Application on their smartphone. It is the User’s responsibility to make sure that these conditions are met.


Before making a reservation, the User will receive, through the Meep App, the location and the registration number of the available vehicle in order to proceed with the reservation. Only the registered User may reserve and drive the vehicles. The User shall be responsible for the vehicle The User knows and undertakes not to lend the vehicle to any other person and not to let any other person drive the vehicle. The User shall return the vehicle within the Designated Area defined on the Meep App. If the User terminates the rental outside of this Designated Area, a penalty shall be applied accordingly as described in the Appendix.


The User shall return the vehicle to a space where motorbike parking is allowed 24 hours a day, with no limitations by time of day and day of week.


The User must be return the vehicle in the same condition as it was first rented and shall report any incident or damage occurred during the rental period. The User’s trip shall be terminated once the vehicle has been turned off and the trip has been ended on the Meep App. If the User does not terminate the rental explicitly using the Meep App as explained above, a penalty shall be applied accordingly as described in the Appendix besides the rental charge continuing to be applied.

 

2. RULES FOR USING THE VEHICLE

 

IoScoot delivers the vehicle to the User in good condition, after it has passed internal checks, including checks on the tyres, brakes, and shock absorbers, among other things.


When accessing the vehicle, the User shall check that the vehicle’s exterior is in good condition, and shall make sure that the helmet and documentation are in the compartment reserved for them. The User must immediately report any dent, rip, or serious damage to any component or part of the vehicle. Failure to communicate implies the User’s acceptance of the vehicle in good condition and the User will be held responsible for any such damages.


The User agrees to use and drive the vehicle according to Maltese traffic rules, and in accordance with the usage specifications for the type of vehicle. Thus, the User agrees not to use the vehicle as listed below:

 

  • To drive in a reckless or unsafe manner

  • To push or tow any vehicle or other object, whether wheeled or not.

  • To take part in competitions, whether official or not, or to carry out material or accessory resistance tests.

  • To drive the vehicle under the effects of alcohol, drugs, or any other kind of narcotic substance.

  • To transport more than the authorised number of passengers indicated on the vehicle’s Registration Certificate and/or Technical Inspection Form (two seats).

  • To transport goods with a weight, amount and/or volume greater than authorised on the vehicle’s Registration Certificate and/or Technical Inspection Form.

  • To transport flammable and/or dangerous goods that are against the law or current legal provisions, goods for illicit purposes, or toxic, noxious, and/or radioactive products.

  • To transport live animals.


The User is expressly prohibited from assigning, hiring, mortgaging, pawning, selling, or in any way giving as a guarantee the vehicle, its documentation, equipment, tools, and/or accessories, and/or any part or piece of the same, or from attempting the above in a manner detrimental to IoScoot or third parties.


The User agrees to leave the vehicle turned off and properly parked during any intermediate stops.


The User shall stop the vehicle as soon as possible at the first sign of a breakdown or malfunction.


The vehicle may not be transported on any means of conveyance, such as by ferry, lorry, or aeroplane.

 
The User is expressly prohibited from manipulating the vehicle, modifying any of the vehicle’s technical features, equipment, tools, and/or accessories, or modifying its physical appearance in any way.

 

3. IN CASE OF BREAKDOWN

 

In the event of a breakdown, the User is required to park the vehicle appropriately, report what happened to IoScoot through the smartphone app, and end the trip in the app. If necessary, IoScoot will be responsible for moving the vehicle to an assistance point.


In the event of a breakdown verified by IoScoot that is not the fault of the User, IoScoot will not charge the User for the reservation.


In the event of a breakdown, the User is not authorised to order vehicle repairs or carry out such repairs by their own means.

 

4. IN CASE OF ACCIDENT OR THEFT

 

In case of accident, the User shall first call the Emergency Services on 112 if this is required. The User shall call an ambulance in the case of any injuries or loss of life, and the police and Local Wardens as necessary. The User must then report the event to IoScoot by whatever means is most appropriate, and if possible, terminate the trip on the Meep App. The User may contact IoScoot on the 2095 8888. The User shall fully cooperate with IoScoot to complete the accident report required by the insurance company, providing IoScoot with the necessary data within a maximum period of 72 hours from the time of the accident.


In the event of theft, the User shall report what happened to IoScoot at the time it occurs. The User shall fully cooperate with IoScoot to complete the corresponding report.

5. IN CASE OF A TRAFFIC FINE

 

IoScoot will notify the User as soon as possible of any reports or fines it is aware of related to the use of the vehicle during the time of the reservation. In the event that the report requires the User to be identified, IoScoot will provide identification to the relevant authorities and notify the affected User.


The User shall be liable to IoScoot for payment of any fines due by IoScoot for traffic violations, unless the fine is due to IoScoot’s failure to respond regarding the identity of the violator.

 

The User agrees that he or she shall take full responsibility for any penalty points or other sanctions that may be imposed by any regulatory or enforcement agency or Authority, and hereby gives the right to IoScoot to provide his or her personal information as having been the driver of the vehicle at any point in time that such penalty point or sanction is imposed on IoScoot, fully understanding that such penalty points or sanctions shall automatically be transferred to the User.

 

6. PRICES AND RATES

 

The price of the rental, along with any registration or recurring fees, is given in the section “Prices” (for service, taxes, and fees) on the Meep App.


The price of the rental includes insurance costs (required civil liability insurance for the vehicle and the driver). The User is the beneficiary of these insurance policies in accordance with their general Terms and Conditions.
In the event of an accident for which the User is at fault, the User will authorise a potential charge to their bank card for an amount beyond the cost of the service itself, with a maximum for the excess (deductible) stipulated in the Appendix, in order to cover any damage to the vehicle.


In the event that the vehicle is damaged, IoScoot will quantify the damages and inform the User of the amount before charging the User back.


Failure to return the helmet(s) provided by IoScoot after terminating the trip will result in a charge as described in the Appendix.


In no case will the aforementioned excess (deductible) cover the price of the service or the penalties outlined in the Appendix.


Cancelling or not starting a reservation for no justifiable reason may result in a charge as specified in the Appendix.


Payment of all sums described in this section shall be made by bank card in the User’s name. The User authorises IoScoot to bill the charges in accordance with these General Terms and Conditions.


The User shall be responsible for bank fees associated with a rejected card charge. In the event that the User does not make any of the aforementioned payments within 24 hours of the time they are due, IoScoot may, with no prior formalities, take judicial or extrajudicial action to demand payment.

7. INSURANCE AND COVERAGE

 

The price of the rental includes the civil liability insurance for the vehicle and damages to third parties, as well as theft and damage incurred by the vehicle for any circumstances beyond the amount set as excess (deductible) in the Appendix.


This coverage is guaranteed and borne by the insurer with which IoScoot has arranged the corresponding insurance policy, and is subject to the agreements made in the general and special terms of the same, and to the legislation in force.


By agreeing to these General Terms and Conditions, which the User acknowledges having read and accepted, the User is automatically becoming a party of the aforementioned insurance policy and will be considered as an insured party.


The maximum liability stipulated by the excess (deductible) will not be applied if the User does not duly complete the corresponding theft report or accident report, which should clearly indicate the information about the vehicle and driver involved in the accident, and the conditions and circumstances in which it occurred.


Nor will this maximum liability be applied in the event that the User fails to meet any of the vehicle’s terms of use listed in Clause 2, in which case the User assumes full responsibility for the consequences, and will pay IoScoot for the full damages that such conduct may bring about.

 

8. COMMERCIAL AND CONTRACTUAL RELATIONSHIP

 

These Terms and Conditions and its Annexes contain all the agreements between the User and MPT Commercial, since the User accepted them in order to enjoy the services offered.

 

By accepting these General Terms and Conditions, the User acknowledges that said Terms and Conditions establish a commercial and contractual relationship between IoScoot and the User. Therefore, the User releases any third parties who may partner with IoScoot in operating or promoting the service from any liability arising from the use of the vehicle or the service in general, and explicitly waives any claim against said third parties.


IoScoot reserves the unilateral right to end its contractual relationship with the User at any time if it believes that the User has failed to meet these General Terms and Conditions, as well as to charge the User the amounts due.

 

9. MODIFICATIONS TO TERMS AND CONDITIONS

 

IoScoot expressly reserves the right to amend and modify these General Terms and Conditions from time to time on the website www.IoScoot.com or in the Meep App.

 

 

10. APPLICABLE JURISDICTION AND LAW

 

This contract will be governed and interpreted in accordance with Maltese law. Questions arising from this contract between the User and IoScoot are subject to the jurisdiction of the Maltese Courts, and both parties submit thereto.


IoScoot reserves the unilateral right to end its contractual relationship with the User at any time if it believes that the User has failed to meet the terms of these General Terms and Conditions, as well as to charge the User the amounts due.

Appendix

 

Penalty fees:

  • Dropping off the vehicle out of the designated zone: 20€ (unless the vehicle has been damaged or there has been an accident)

  • Not finishing the booking through the Smartphone app:10€ 

  • Cancelling the booking before the 15 minute courtesy period plus the extra 10 minute period:1€

  • Not starting the booking before the 15 minute courtesy period plus the extra 10 minute period:1€

  • Picking up the vehicle in a car impound due to non-authorized parking: 20€ plus the price of the fine

  • Not returning the helmet: 50€

  • Losing the vehicle documentation: 5€

  • Not giving the accident data in order to fulfill the accident report form if necessary: 30€

  • Insurance excess: 350 €

  • Damages to the moto: Up to 500€ depending on the value of parts

NOTES:  VAT is included in all the rates of the Terms and Conditions. The rates are subject to change.
